Social Equity

Ownership, Control & Equity Requirements

55% Ownership Threshold

Effective July 1, 2026, a social equity applicant must have at least 55% ownership and control held by qualifying individuals. This replaced the original 65% threshold, allowing more outside investment while preserving qualifying control.

Qualifying Pathways

  • Residence in a disproportionately impacted area for at least 5 of the preceding 10 years
  • Attendance at a public school in a disproportionately impacted area for at least 5 years
  • Attendance for at least 2 years at a 4-year Maryland institution where at least 40% of students were eligible for Pell Grants

Ownership Transfer Restrictions

MCA generally restricts control transfers during the first five years of a new license. Converted licensees generally cannot transfer control before July 1, 2028. Exceptions include death, incapacity, bankruptcy, receivership, and certain court or employee-ownership arrangements. Management agreements require prior written MCA approval.

Cannabis Business Assistance Fund

Commerce's published social equity conditional-license grant maxima. Funding is subject to eligibility, approval, documentation, and available funds — disbursed through four milestones, not paid automatically. Verify current intake before relying on a grant in a financing plan.

Social Equity Partnership Program

The 2025–2026 round allocated grants up to $100,000 for micro partnerships and $200,000 for standard partnerships. Partners cannot own or control one another, and assistance cannot be used to impose branding or operating control. The December 2025 application window has closed — watch for future rounds.

Taxes

Tax Rates & Community Reinvestment

12% Adult-Use Tax

Effective July 1, 2025 (up from 9%). Qualifying medical cannabis purchases remain exempt. Accessory and electronic smoking device tax treatment should be checked separately.

Q2 2026 Collections

$28,685,226 in cannabis tax collections for Q2 2026. The additional revenue from the 2025 three-percentage-point increase goes to the General Fund before the remaining allocation process.

Community Reinvestment Fund

After specified prior allocations, 35% of remaining distributable revenue goes to the Community Reinvestment and Repair Fund — supporting low-income communities and those disproportionately affected by cannabis enforcement.

Operations

Operating Requirements Updated Since 2023

Cannabis Agent Training

Effective July 1, 2026, Cannabis Agent Training replaced Responsible Vendor Training. Registered agents must complete approved training within 90 days of starting and at least once every two years. Programs must provide at least two hours of instruction.

Packaging & Labeling

September 14, 2026 amendments removed the general plain-packaging requirement while retaining opaque, child-resistant, tamper-evident packaging and resealability for multiple servings. Restrictions on designs appealing to people under 21 were expanded. Medical or therapeutic claims remain prohibited on packaging.

Advertising Rules

At least 85% of the reasonably expected audience must be 21+. Advertising directly targeting people under 21 is prohibited. Limited additional exterior signage and specified exemptions are now authorized. The required event-host attestation process has a January 1, 2027 rulemaking deadline.

Cultivation & Canopy

Canopy calculations measure flowering plants and count each tier of vertical cultivation. Vegetative and mother-plant areas are excluded. Expansion or reconfiguration requires prior MCA approval. Eligible growers and processors may share premises or equipment under co-location rules — must prevent commingling and maintain separate storage control.

Hemp & Intoxicating Cannabinoids

Products for human consumption or inhalation containing more than 0.5 mg THC per serving or more than 2.5 mg THC per package are restricted to licensed cannabis channels. Exception: qualifying hemp-derived tinctures with at least 15:1 CBD-to-THC ratio, max 2.5 mg THC per serving, max 100 mg per package. SB 820 (effective July 1, 2026) expanded ATCC enforcement authority.

Zoning & Location

Dispensaries generally prohibited within 500 feet of schools, licensed child care centers, playgrounds, recreation centers, libraries, public parks, and places of worship. Default dispensary-to-dispensary separation: 1,000 feet. Local governments may reduce sensitive-use distances or increase dispensary separation to no more than one-half mile.

Regulatory Proposals to Monitor

September 2026 Informal Regulatory Draft

MCA published an informal regulatory draft in September 2026 and accepted initial comments through October 7, 2026. As of October 9, 2026, that draft is not a final adopted rule. Proposed provisions include:

  • Additional renewal and tax-compliance requirements
  • Conditional-license response obligations
  • Allergen placement on the outer marketing layer
  • Revised transfer-review language
  • Regulatory text implementing already-enacted changes (55% threshold, 20-agent micro dispensary limit, Cannabis Agent Training) — those statutory changes are already effective even though related regulatory amendments remain in draft form

Monitor the MCA rulemaking page for final adoption.
